These Agreements and Policies contain important information regarding your legal rights, remedies and obligations that govern your use of the IDEEZA Platform. We may, at our sole discretion Terms and Conditions of Use, license agreement and any other Agreement(s) or Policies at any time by posting a revised version on the Site.

We shall provide reasonable advance notice of any substantial revision to these Agreements and/or policies by providing notice on the Site, and/or by sending you notice of such changes by email. Any revisions to the Terms and Conditions of Use, license agreement and any other Agreement(s) or Policies will take effect on the noted effective date (each, as applicable, the “Effective Date”).

You acknowledge and agree that by continuing to use the Platform, Application, Website or Services after the effective date of the changes, you agree to be bound by the Terms and Conditions of Use, license agreement or any such Agreement(s) and/or Policies.

If you do not accept the Terms and Conditions of Use, license agreement and/or any other Agreement(s) or Policies in their entirety, you agree not to access or use the Platform, Application, Site and/or Services after the effective date of the changes.

1. Applicability and Disclaimer

This Privacy Policy applies to the closed group of Beta Testers invited and permitted by the Company to participate in the testing of the Beta Product. The Tester understands that the Beta Product is not a commercial product of the Company and may have risks and faults such as bugs, errors, performance and compatibility issues, and other vulnerabilities. The Beta Product has been launched solely to test the usability, functionality, bug detection, and internal evaluation of the Product. The Beta Tester has agreed to participate in the testing phase. The Tester is part of a limited group that has been invited to test the Product and provide suggestions, opinions, and feedback on the same.

2. Information We Collect, Its Purpose, and Use

INFORMATION YOU PROVIDE: Tester has to provide certain information primarily required for identifying the Tester, facilitating the usability of the Product, collecting feedback, and improvement of the Product. To access the Product, the Tester needs to create a User Account on the platform. To create a User Account, the Tester has to provide information such as name, e-mail address, gender, and phone number. Additionally, the Tester also has the option to create a User ID by signing in through Tester's Facebook and Google accounts. We collect and store e-mail ID, user name, and profile photo if such third-party platforms are used to log in and access the Product. We collect and store such information to maintain our record and to contact the Tester for their feedback and suggestion on the efficiency of the Product. We will also use such information to verify the identity and ascertain that the Tester is part of the closed group of testers invited by the Company for testing. Information such as e-mail Id and phone number will be also used for notifications. We are not retaining any financial data of Testers.

If the Tester is buying or selling his project created on the Platform or the Tester is buying or selling NFT on the IDEEZA NFT MARKETPLACE, we will not collect information such as credit/debit card data, Paypal account information, and crypto wallet address for processing transactions and billing purposes.

For testing the efficiency of the Product, the Tester is allowed to create and design projects on the platform. The information related to the projects is not personally identifiable information. However, we may require information such as copyright registration, patent registration details, and a document certifying the intellectual property ownership associated with the project. Such information is required to verify the authenticity of the intellectual property claim on the project.

We will collect the feedback provided by the Tester during the testing process. The feedback will be used for internal evaluation of the Product.

AUTOMATIC INFORMATION: During the testing phase, we may collect information automatically gathered when the Tester interacts with the Beta Product. Such information details about the device used to access the Product, such as the device type, operating system, browser or app version, unique device identifiers, IP address, and network information, system-generated log files record activities and events that occur during a Tester's interaction with a Product such as timestamps, page views, clickstream data, error logs, and referring/exit pages. We may also automatically collect cookies and trackers such as web beacons and pixels. Testers may, depending on their respective web browser, delete cookies at any time and/or make general settings with regard to the acceptance, rejection, and deletion of cookies.

The above information may be used for Product improvement, diagnosing issues, bugs, or performance problems, identifying patterns, usage trends, feature preferences, and areas where end-users may encounter difficulties, and analysing user experience.

Nevertheless, the Tester understands that the Company is not providing any service to the Tester and the Product is not a commercial product, hence, not a part of the core business activities of the Company. The above information collected, stored, and used is primarily for the purpose to test the efficiency, usability, effectiveness, and performance of the Product. The personal information will be used to contact the Tester for feedback, suggestion, and opinion on the Product.

The Tester's personal information will not be used for monitoring purposes. We will not use the data of the Tester for tracking, profiling, analysing, and predicting the behaviour of the Testers.

3. Modification, Deletion of Information

The Tester is in control of personal information collected by us during the testing phase. Tester can view and modify the personal information by accessing Tester's respective User Account on the platform. Tester can also delete the personal information collected and stored by us here. The Tester may delete the User's Account post-termination of the testing period. If the Tester deletes the User Account, the personal information related to such account will be permanently deleted from the system of the Company. We do not retain users' data for more than fifteen (15) days once the User Account has been deleted.

4. Sharing of Personal Information

We do not share personal information collected from the Testers with third parties. However, we may disclose your personal data, in good faith, where such action is necessary to:

  • comply with a legal obligation or law enforcement agency request;
  • protect and defend the rights or property of the Company;
  • prevent or investigate misuse of the Beta Product, possible wrongdoing in connection with the use of the Beta Product;
  • protect against legal liability;
  • prevent infringement of anti-money laundering law, anti-terror law, and intellectual property law

5. Use of Testing Data for AI Model Training and Improvement

The Tester acknowledges and expressly agrees that all data, information, inputs (including but not limited to text descriptions and prompts), outputs (including but not limited to generated blueprints and any derived digital assets like NFTs), usage patterns, performance metrics, and any other data or information generated by or collected from the Tester's interaction with the Beta Product during the testing phase (collectively, 'Testing Data'), shall be the sole and exclusive property of the Company.

The Tester hereby irrevocably assigns to the Company all worldwide right, title, and interest, including all intellectual property rights (including copyright, moral rights to the maximum extent permitted by law, and any other proprietary or similar rights, whether now known or hereafter existing), in and to such Testing Data.

The Company shall have the unrestricted right to use, reproduce, modify, adapt, translate, create derivative works from, distribute, perform, display, and otherwise exploit Testing Data for any purpose whatsoever, including, without limitation:

  • For the training, fine-tuning, and improvement of the Company's existing and future artificial intelligence models, algorithms, and related technologies.
  • For product development, enhancement, and optimization.
  • For research and development.
  • For commercialization of products and services derived from or enabled by such Testing Data.
  • For demonstrating and showcasing the capabilities of the Company's AI technology.

The Tester understands and agrees that this use of Testing Data for AI model training and other purposes will be without any compensation, attribution, or additional permission required from the Tester.

6. Security of Information

We take all reasonable measures to protect the personal information we collect from the Testers. To report any data breach, Testers may reach out to us at marketing@ideeza.com. However, the Testers are advised to be cautious while using the Product. The Testers shall take preventive measures for protecting their information. The Testers understand that the Beta Product is not a commercial product and has been launched solely for the purpose of testing its performance. The tester understands that the Product may be exposed to bugs and security vulnerabilities.

We reserve the right to modify this Privacy Policy. If the Policy is modified, we will update the Testers on their registered e-mail IDs.
